Limited Licence Refused? What Happens Next

A refusal hurts, especially when your job depends on driving. Here is where you stand, and what your real options are.

You still cannot drive

A refused application changes nothing about your suspension or disqualification. It runs for its full term [1]. Driving anyway is an offence under section 32(1), and a disqualification for that offence is one you can never get a Limited Licence for [1].

Find out why

Write down what the judge says, or ask the court for a copy of the decision. Most refusals come down to one of these:

  • Not eligible. Something in section 103(2) ruled you out, such as a repeat offence within 5 years or an alcohol interlock sentence [1].
  • Hardship not proved. The affidavit said things would be hard, but did not show it with facts [3]. The bar is extreme hardship to you, or undue hardship to someone else [1].
  • Missing evidence. Work hardship with no employer affidavit, or letters nobody confirmed on oath [3].
  • Too much driving asked for. The court can only grant the least driving needed [1].
  • Public safety. The judge was not satisfied the order would be safe, often because of your driving history [1].
  • Not turning up. If you are late or miss the hearing, the application can be struck out [4].

Applying again

After a refusal, the court will not consider another application about the same disqualification or suspension for at least 3 months [1]. There is one exception. The court can accept a further application sooner if it is supported by relevant evidence that was not available at the first hearing [1].

A new job, a change in someone's care needs, or an employer who can now give evidence might count. The same application with tidier wording usually will not.

Filing fees are not refunded when an application is declined [2], so a second attempt means paying again.

Appealing

If a District Court disqualified you, section 107 gives you a right of appeal to the High Court against a refusal to grant a Limited Licence [1]. Appeals are legal work with strict time limits, so if you are thinking about one, talk to a lawyer promptly. We prepare application documents. We are not a law firm and we do not run appeals.

When the court says yes but NZTA says no

Sometimes the court makes the order and NZTA then declines to issue the licence, because it finds you were not entitled to apply [1]. NZTA sends a letter with its reasons and explains how to appeal to the District Court [5].

Fixing a weak application

If you are eligible and the problem was evidence, the fix usually looks like this:

  • facts instead of claims in your affidavit [3]
  • a sworn affidavit from your employer, or from the person who depends on you, rather than a letter [3]
  • every previous driving related conviction disclosed [3]
  • days, hours, vehicles and routes that match your real life and nothing more [1]

Every affidavit is signed only in front of the person who witnesses it, and the easiest place to do that is at the court when you file. Never sign one in advance. Once it is signed, not a word can change unless the change is also signed and witnessed.
